Art represents lenders and debtors in connection with loan workouts, corporate restructurings, and Chapter 11 proceedings. He has advised senior lenders, second-lien lenders, and debtors, both in court and out of court, across a wide range of industries, including retail, wholesale, healthcare, automotive, telecommunications, investment management, and energy. He has also represented debtors, creditors, and trustees in bankruptcy litigation, including preferential and fraudulent transfer actions.

In 2006 and 2007 Art was recognized as a "Rising Star" in the field of bankruptcy by Law & Politics and the publishers of Boston Magazine.

Representative Transactions

  • Represented agent bank in connection with $30 million debtor-in-possession revolving credit facility for national retail chain
  • Represented second-lien lenders owed over $38 million in large retail Chapter 11 case, resulting in full payment
  • Represented agent for senior lender group owed over $165 million in out-of-court sale of distressed borrower's assets
  • Represented $310 million hospital debtor, concluding with confirmation of Chapter 11 plan and emergence from bankruptcy
  • Represented telecom debtor in negotiating and litigating disputes in Chapter 11 case arising from divestiture of a $300 million business unit, resulting in court-approved settlement
  • Represented Chapter 11 debtor in objecting to and resolving claims aggregating in excess of $200 million
  • Represented Chapter 11 debtor in successful sale of unprofitable division
