Alex represents commercial banks and other financial institutions in bankruptcy, workout, and debt restructuring transactions. His practice focuses on the enforcement of creditors' rights under Article 9 of the Uniform Commercial Code and the Bankruptcy Code.
Alex's work with lenders regularly involves negotiating and documenting restructured financing arrangements, modification agreements, and forbearance agreements. When necessary, Alex's practice involves the enforcement of creditors' rights, including real estate foreclosures, and Article 9 secured party sales. Alex also appears on behalf of lenders in state and federal courts (including bankruptcy courts) in Massachusetts and New Hampshire.
Representative Transactions
- Represented secured lender in restructuring of over $40 million in secured convertible debt to biodiesel producer
- Represented secured lender and agents in restructuring of $40 million revolving credit facility to national jewelry retailer
- Represented secured lender in connection with enforcing lender’s rights and remedies against single asset real estate debtor in a Chapter 11 bankruptcy proceeding, resulting in relief from the automatic stay and conversion to Chapter 7
- Represented secured lender in organized liquidation of automobile tire manufacturer and its Canadian affiliates
- Represented secured lender in connection with the sale of telecommunication company’s Canadian subsidiary
- Represented secured lender in secured party sale of stock in subsidiary telecommunications companies
- Represented mezzanine lender in connection with secured party sale of limited liability company membership interests in borrower’s subsidiary
