Don specializes in creditors’ rights, problem loan restructurings, secured and unsecured commercial finance, and real estate and asset-based loan workouts. He regularly represents the agent in a lending syndicate, as well as independent lenders.
For clients that are involved in transactions in the early stages of financing, Don structures and documents loan arrangements. He also represents clients in mid-course restructurings and in formulating troubled debt workouts. Don also implements the enforcement of creditors’ rights and remedies when necessary in loan arrangements where efforts to implement alternative resolutions have been unsuccessful. Don's clients have credit arrangements with companies operating in a broad spectrum of industries, including real estate development and finance, manufacturing, retail, and high-tech life sciences.
Don also travels throughout the country to implement financial arrangements, enforce lenders’ rights and remedies, and appear in bankruptcy courts. He appears regularly in the bankruptcy courts for the Southern District of New York and the District of Delaware, and has appeared in numerous other bankruptcy courts and handled cases in 47 states throughout the country. Don is a frequent lecturer on legal current events and other topics.

- Commercial real estate construction lender in a multi-phased residential subdivision development
- Commercial lending group financing the construction of a combined golf course and residential gated community
- Tranche B lender in the financing of manufacturing facilities
- First-tier secured creditors in connection with the wind-down and ultimate liquidation of a multinational apparel manufacturer
- Equipment lessors in adversarial litigation in Bankruptcy Court
- Investors as a “stalking horse” seeking to acquire the business and assets of a regional airline out of a Chapter 11 proceeding
