Brett has served as counsel to secured lenders in complex workout matters, including negotiating and documenting cash collateral facilities, as well as represented debtors, official and unofficial creditors' committees, official equity committees, and other significant parties in national Chapter 11 cases. He also has performed transactional work in numerous cases with sellers, purchasers, lenders, and secured and unsecured creditors of financially troubled companies, non-judicial, and Chapter 11 restructurings.

Representative Transactions

• Represented senior secured lender in complex bankruptcy and restructuring of $15 million in receivables and real estate facilities of multi-resort timeshare company
• Represented senior secured lender in bankruptcy of regional printer and logistics company
• Represented senior secured lender under a $40 million receivables and floor plan financing facility in complex bankruptcy and sale of national watercraft manufacturer, distributor and retailer
• Represented senior secured lender in complex bankruptcy and restructuring of $30 million in receivables, timeshare inventory and real estate acquisition and development facilities of multi-resort timeshare company
• Represented regional discount retailer in Chapter 11 restructuring
• Represented national furniture retailer in Chapter 11, including sale and liquidation of strategic assets
• Counsel to official creditors' and equity committees in complex bankruptcy cases
